The City of Oshawa and Tribute Communities' Neighbourhoods of Windfields Farm LP argued that the subdivision was zoned for single-family use and that the landlords were essentially using the dwellings as multifamily lodging houses.
The city took part in the suit in order to get a legal ruling on its zoning-enforcement bylaw. On the surface, the court action seems like a selfless and civic-minded effort on the part of Tribute to protect the integrity and fabric of its master-planned community.
